ACLU bombs The Pentagon

The Boy Scouts’ Jamboree, held every four years, is an epic event for bucolic Caroline County, Va.

Held at Fort A.P. Hill for 25 years, the event more than triples the county’s population, bringing 40,000 Scouts, leaders and staff together for 10 days of sports, conservation activities and the construction of a tent city so elaborate that military officials compare it to a refugee camp.

The jamboree is also an important event for the U.S. military, which has been supporting it since the 1930s with contractors, 1,500 troops and $2 million a year in Defense Department funding. However, that relationship is coming under scrutiny.

A federal judge ruled late last month that the Pentagon funding is unconstitutional because the Boy Scouts are a religious organization, requiring Scouts to affirm a belief in God. The case was initiated by the American Civil Liberties Union.

And, there’s some fall-out:

The Scouts and their advocates - including Senate Majority Leader Bill Frist, a Republican from Tennessee, and Rep. Jo Ann Davis, a Republican from Virginia, whose district includes Fort A.P. Hill - are livid, saying the jamboree provides a unique training opportunity for troops. Among those speaking out this week was Nathan Diament, director of public policy for the Union of Orthodox Jewish Congregations of America, who said the ruling in U.S. District Court for the Northern District of Illinois amounts to "discrimination against religious entities."

I couldnt agree more.  The Scouts don’t teach a religion, they simply affirm it.  They didn’t teach Christianity or Judaism, this is EXACTLY what they are required to say:

On my honor I will do my best
To do my duty to God and my country
and to obey the Scout Law;
To help other people at all times;
To keep myself physically strong,
mentally awake, and morally straight.

That is not pushing one religion over another.  That does not violate the Constitution, no matter how convoluted you may interpret the Constitution.

What the ACLU is doing is pushing the bar too far.  When Bush first proposed his Faith Based Initiative, it was met mostly with ridicule. Quite honestly, I was in that camp as I didn’t see a need for it.  What the ACLU is doing in their endless attack is giving Bush’s Faith Based Initiative credibility.

This ruling by Judge Blanche Manning is just horrendous.  Judge’s never explain their rulings unless it’s on the absolute highest levels, but I sure would like to see her opinion.  It originated from a lawsuit filed by the Reverend Eugene Winkler who states:

"We’re not attacking the Scouts and neither is the ACLU," Winkler said. "This issue is not about the Boy Scouts at all. It’s about government funding for religious purposes. It’s about separation" of church and state.

I get so tired of that argument being the crux of every ACLU issue.  There is nothing religious about the functions of the jamborees.  Government is NOT PROMOTING ONE RELIGION when it supports the Boy Scouts.  How in the hell Blanche Manning doesn’t realize the basic principal of the Constitution is beyond me.  Of course, when the rights of NAMBLA outweigh the Boy Scouts, that should tell you something.

    I would like to see this case argued before the Supreme Court post John Edwards confirmation.

    Me thinks the tide may turn in a more sensible fashion.

    It doesn’t hurt that Edwards is Catholic although I firmly beleive his personal views would never come into his decision making process with regard to Constitutional Law.

    I do think however that these vile assinine lawsuits brought by the ACLU scum will be handled and settled in a more sane fashion we could not assume under Judge O’Conner.

    I have no idea what I was thinking when I referred to John Roberts as John Edwards. Ot must have been a Freudian slip.

    And what a slip it is. I can’t think of anyone more likely to be scared stiff by Roberts being on the bench than Edwards.

    How true that is. The real issue IMO is what happens after 2006 elections.
    Republicans pick up enough seats to be in a 60+ majority and the ACLU party is over FOREVER.
    Bush will have IMO 3 more seats to fill and after 2006, he will have absolutely no reason to play nice with the Left. Payback is a bitch.
    Imagine a solid 7-2 Conservative majority for the next 30+ years on the court?
    If that were ever the case, if the Dems ever got back control of Congress, there would be an attempt at a Constitutional Amendment to increase the size of the court to at least 15.
    Taking any wagers?
