Judge Perkins and Moveon

Posted by Moonage on 22 Oct 2005 | Tagged as: The Legal Process

A lot has been made of Tom Delay asking Judge Perkins to recuse himself from the trial.  People opposed to this are already pointing out that the next judge up the ladder is Republican and has donated to the Republican Party.

The difference folks is obvious to me. The issue was Moveon, NOT Democrats. Moveon had attacked Delay directly by printing material proclaiming Delay’s guilt. The judge contributed to Moveon WHILE they were proclaiming Delay’s guilt. IF the next judge can show more evidence of impartiality IN DIRECT REGARDS TO DELAY than not, then they should be able to hear it.

All judges will be of some party. That’s never been an issue.

A little known tidbit of information here would be critical to make a fair decision about Judge Perkins and his politically charged situation.

Approximately 10 years ago, Kay Bailey Hutchinson found herself in a similar situation wherein she was brought up on charges that were entirely fueled by politics.

The Judge in that case was, you guessed it, Judge Perkins. A similar request for recusal was made by the Hutchinson legal team and it was found to be of merit. That Judge Perkins was so deep into the Partisan Politics of Texas he had an absolute conflict of interest and was recused from the case.

I suspect nothing has changed in 10 years and Judge Perkins should be recused from the case, the hearing should have a change of venue and considering it took 3 seperate Grand Juries to get an indictment, the Prosecutor in this case needs to be investigated as well.

As I have stated in this blog before, Texas Politics is a dirty, no holds barred, full contact sport. Understanding the nature of the political game in Texas, no of this should come as a surprise. And to think Kentucky was an ol’ boy network. We couldn’t hold a candle to the Texas system.

Good point Bryan. I think it should be noted more visibly ( read MSM ) that Perkins was recused before. But, for some reason, it’s not.

    Judge Perkins and Moveon, updated

Updating a post I made earlier, as I opined, Judge Perkins has been removed from the Delay case. Also updating that post, the Republican judge opponents voiced concerns over will not automatically receive the case.
